Genius Eye News — Terms of Use
Draft for attorney review. This document has not been approved by a licensed attorney and is not yet in force.
Effective date: [DATE OF LAUNCH] Last updated: [DATE OF LAUNCH]
These Terms of Use ("Terms") are an agreement between you and [LEGAL ENTITY NAME], doing business as TRG Tech Link and Genius Eye News ("Genius Eye News," "we," "us," or "our"). They govern your use of geniuseyenews.com, its city editions, newsletters, live pages, World Watch alerts, classifieds marketplace, self-serve advertising tools, and any related features (together, the "Service").
By using the Service you agree to these Terms and to the policies they incorporate:
- Privacy Policy
- Cookie Policy
- Advertising Policy and Political Advertising Policy (for advertisers)
- Classifieds Rules (for anyone who posts a listing)
- Corrections Policy
- How We Use Automation
- Copyright & DMCA Policy
If you do not agree, do not use the Service.
Important: Section 17 contains a binding individual arbitration agreement and a class-action waiver that affect how disputes are resolved. Please read it.
1. Who may use the Service
- Reading the Service is free and open to the public. You do not need an account to read news.
- Accounts (needed to post classifieds, buy advertising, or manage newsletter preferences) are available only to people who are at least 13 years old. To buy advertising, post a paid or promoted listing, or enter any contract with us, you must be at least 18 (or the age of majority where you live) and able to form a binding contract.
- The Service is a general-audience news site. It is not directed to children under 13, and we do not knowingly collect personal information from them. See the Privacy Policy.
- If you use the Service on behalf of a business or other organization, you represent that you are authorized to bind it to these Terms, and "you" includes that organization.
2. What the Service is — and what it is not
Genius Eye News publishes local news for city editions (currently Raleigh, Charlotte, Charleston SC, Atlanta, Miami, Orlando, Tampa, Richmond, Washington DC, Baltimore, Los Angeles, San Francisco, San Jose, San Diego and Sacramento), plus national, world, politics, business/markets and "Good News" coverage.
News is produced with automation. Many of our stories are drafted by automated newsroom software that works from public government data (for example the National Weather Service, National Hurricane Center, U.S. Geological Survey, FEMA, the SEC and the Federal Register) and from reading other outlets' public reporting, which we link to. Every story passes an automated fact-check step, and our editors can correct or unpublish any story. Details are in How We Use Automation. Despite these safeguards, news is often reported while events are still developing and may be incomplete, out of date or wrong. See our Corrections Policy to report an error.
Not emergency information. Weather, hurricane, earthquake, flood, traffic and disaster information on the Service is provided for general awareness only. It may be delayed, incomplete, or superseded. Always follow instructions from official sources (for example weather.gov, nhc.noaa.gov, ready.gov, your local emergency management agency, and 911). Do not rely on the Service to make safety or evacuation decisions.
Not investment, financial, legal or tax advice. Market data, stock and commodity quotes, business coverage, and World Watch scores and "what it could mean" analysis are for general information only. Market data may be delayed (generally by at least 15 minutes, and sometimes more) and may contain errors. Nothing on the Service is a recommendation or solicitation to buy, sell or hold any security, commodity, currency or other asset. We are not a registered investment adviser or broker-dealer. Consult a qualified professional before making financial decisions.
World Watch. World Watch scores and alerts are generated by an automated model that weighs reported global events. Scores are an editorial estimate of significance — not a prediction, a guarantee, or advice. They may change without notice.
Third-party live streams and camera images. Live pages embed official third-party live streams (for example via YouTube) and government traffic-camera images, with attribution. We do not control, produce, or guarantee that content, its availability, or its accuracy. Embedded players are governed by the provider's own terms and privacy policy (for example, YouTube's Terms of Service and Google's Privacy Policy).
Links to other sites. We link to original sources and other outlets. We are not responsible for third-party websites, their content, or their privacy practices.
3. Your account
You are responsible for the accuracy of the information you give us, for keeping your password secure, and for activity under your account. Tell us promptly at news@geniuseyenews.com if you think your account has been compromised. We may suspend or close accounts that violate these Terms, that appear to be fraudulent, or that have been inactive for an extended period.
4. License to use the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and read the Service for your own non-commercial use. You may share links to our articles and quote brief excerpts with attribution and a link back.
5. Things you may not do
You agree not to:
- Copy, republish, sell, or redistribute our articles, headlines, data compilations, World Watch scores, or other content in bulk, or frame or mirror the Service, without our written permission.
- Scrape, crawl, or use automated means to collect content or data from the Service, including to train, fine-tune, or ground artificial-intelligence models, except (a) general-purpose search engines indexing in compliance with our robots.txt, or (b) with our written permission.
- Interfere with, overload, or try to gain unauthorized access to the Service, our servers, or other users' accounts; probe or scan for vulnerabilities (see "Security research" below); or introduce malware.
- Use the Service to harass, threaten, defraud, impersonate, or discriminate against anyone.
- Post or advertise anything unlawful, or anything that violates our Classifieds Rules or Advertising Policy.
- Remove or obscure attribution, copyright notices, "Sponsored" labels, or political ad disclaimers.
- Misrepresent your identity, your affiliation, or the source of any listing or advertisement.
- Use the Service in violation of export-control or sanctions laws.
Security research: If you believe you have found a security vulnerability, please report it to admin@trgtechlink.com and give us a reasonable time to fix it before disclosure. Do not access, modify or delete other people's data.
6. Content you submit
"User Content" means anything you submit to the Service, including classified listings, photos, advertising creative, tips, comments, correction requests, and messages.
- You own your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, format, translate, and distribute it in connection with operating, promoting and improving the Service (for example, displaying your listing in the relevant city edition, sending it in a newsletter digest, or showing your ad). This license ends when you delete the User Content or your account, except for copies retained in backups, as required by law (for example political advertising records), or that others have already shared.
- You are responsible for your User Content. You represent that you have all the rights needed to submit it, that it is accurate, and that it complies with these Terms and the law.
- News tips and correction requests. If you send us a tip, we may use the information in our reporting. We protect the identity of people who ask to remain confidential to the extent permitted by law, but we cannot guarantee confidentiality against legal process.
- Screening and moderation. We automatically screen and may manually review User Content. We may refuse, edit for format, label, limit, or remove any User Content at our discretion, including for violations of our rules. We are not obligated to monitor User Content and do not endorse it. Our moderation decisions are editorial judgments.
7. Classifieds marketplace
The classifieds marketplace lets users post listings for items for sale, housing and rentals, jobs, services, vehicles and events. We are not a party to any transaction between users. We do not own, inspect, or guarantee any item, property, job, or service listed, and we do not verify the identity of users or the truth of listings. Deal at your own risk, follow our safety tips, and never wire money, send gift cards, or pay a deposit for a rental you have not seen. All listings must follow our Classifieds Rules, including federal and state fair housing and equal employment opportunity laws.
8. Advertising and paid features
If you buy display advertising, city takeovers, sponsored articles, show sponsorships, promoted listings, or other paid placements ("Paid Features"):
- Policies. Your ads must comply with our Advertising Policy and, if applicable, our Political Advertising Policy. We may reject, pause, or remove any ad at any time. Political ads are accepted only after human review.
- Labels. Sponsored content is clearly labeled "Sponsored." Ads for our affiliated companies are labeled "From the Genius Eye family of companies." You may not ask us to remove or soften these labels.
- Pricing and payment. Prices are shown before you buy. You authorize us to charge your chosen payment method for the total shown, plus any applicable taxes. Payments are processed by TRGPay, our affiliated payment engine, which uses third-party card, ACH and Zelle processors. Additional terms of those processors may apply.
- No guarantee of results. Impression, click, and reach estimates are estimates. We do not guarantee any level of performance, placement next to specific content, or business results.
- Refunds. Unless the order screen says otherwise: (a) you may cancel an ad campaign that has not started for a full refund; (b) once a campaign has started, unused prepaid amounts are refundable on a pro-rata basis if you cancel, less any non-refundable creative or setup fee disclosed at purchase; (c) promoted-listing fees are non-refundable once the promotion has started, unless we remove the listing in error; and (d) if we remove an ad or listing because it violates our policies, we are not required to refund amounts already used, and we may withhold refunds where we reasonably suspect fraud. [Attorney/business to confirm refund policy.]
- Recurring purchases. If you choose a recurring ad package or auto-renewing promotion, we will clearly show the price, billing frequency, and how to cancel before you purchase, obtain your express consent, send a confirmation, and let you cancel online as easily as you signed up. Cancellation takes effect at the end of the current billing period.
- Chargebacks. If you dispute a valid charge, we may suspend your advertising account while the dispute is resolved.
- Taxes. You are responsible for any taxes other than taxes on our net income.
Additional insertion-order terms may apply to managed or high-value campaigns. If they conflict with these Terms, the insertion order controls for that campaign.
9. Newsletters and alerts
You can sign up for email newsletters and alerts. We use double opt-in: your subscription starts only after you click the confirmation link we email you. Every newsletter has an unsubscribe link, and we honor unsubscribe requests promptly (and in any case within 10 business days, as required by the CAN-SPAM Act, 15 U.S.C. § 7704). Newsletters may contain advertising, which will be labeled.
10. Our intellectual property
The Service, including our original articles, headlines, summaries, graphics, data visualizations, World Watch scores, software, the "Genius Eye" name and logos, and the selection and arrangement of content, is owned by us or our licensors and protected by copyright, trademark, and other laws. Except for the limited license in Section 4, no rights are granted to you. Facts and public-domain government data remain free for anyone to use; our expression and compilation of them is protected to the extent the law allows.
11. Copyright complaints
We respect copyright. Our news process links to sources and does not copy other outlets' text or photos. If you believe content on the Service infringes your copyright, follow the notice procedure in our Copyright & DMCA Policy. We terminate the accounts of repeat infringers in appropriate circumstances.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT LIVE STREAMS, CAMERA IMAGES, ALERTS, OR MARKET DATA WILL BE AVAILABLE OR CURRENT, OR THAT ANY LISTING OR ADVERTISEMENT IS ACCURATE OR LAWFUL. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR AFFILIATES, OFFICERS, EMPLOYEES, OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE, ANY CONTENT, ANY TRANSACTION BETWEEN USERS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100.
These limits do not apply to liability that cannot be limited by law, such as for our gross negligence, willful misconduct, or fraud.
14. Indemnity
If you post User Content or buy advertising, you will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your User Content, your ads, your transactions with other users, or your violation of these Terms or the law. We will notify you of any such claim and may participate with counsel of our choice.
15. Suspension and termination
You may stop using the Service at any time and may delete your account from your account settings or by emailing news@geniuseyenews.com. We may suspend or terminate your access, remove content, or refuse service if you violate these Terms, if required by law, or to protect users or the Service. Sections that by their nature should survive (including 6, 10, 12–14, 16–18) survive termination.
16. Governing law and venue
These Terms are governed by the laws of the State of North Carolina and applicable federal law, without regard to conflict-of-laws rules. Subject to Section 17, the state and federal courts located in Wake County, North Carolina have exclusive jurisdiction, and you and we consent to personal jurisdiction there. [Attorney to confirm county/venue.] Nothing in this Section deprives you of protections that the consumer laws of your state of residence give you and that cannot be waived by contract.
17. Dispute resolution, arbitration, and class-action waiver
[Attorney review required: confirm whether to include arbitration at all, choice of provider, fee allocation, and mass-arbitration protocol.]
- Informal resolution first. Before filing a claim, you agree to email admin@trgtechlink.com with a description of the dispute and give us 60 days to try to resolve it informally. We will do the same.
- Binding individual arbitration. Any dispute that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or, for business advertisers, its Commercial Arbitration Rules). The Federal Arbitration Act governs this Section. The arbitration may be held by video or in the county where you live.
- Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court for intellectual-property misuse or unauthorized access.
- Class-action waiver. You and we may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding.
- Opt-out. You may opt out of this arbitration agreement by emailing admin@trgtechlink.com within 30 days after you first accept these Terms, with your name and a statement that you opt out.
- Severability. If the class-action waiver is found unenforceable for a claim, that claim will proceed in court under Section 16, not in arbitration.
18. General
- Changes. We may update these Terms. If a change is material, we will give notice on the Service or by email at least 14 days before it takes effect (except for changes required by law). Continued use after the effective date means you accept the change.
- Entire agreement. These Terms and the incorporated policies are the entire agreement between you and us about the Service.
- Severability; no waiver. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, outages of third-party providers, or government action.
- Electronic communications. You agree to receive notices electronically.
- California users. Under California Civil Code § 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
